most insanity defenses bring into question the defendant's mental competency at the time of his crime. not so in this case. steven hayes' lawyer is arguing that his client is in "no condition to continue," due to the nature of his incarceration.
if this ploy doesn't work, the defense can always argue that the trial is driving hayes crazy, or the deliberations, the sentencing and so on...
